In my 30-plus years as a family law attorney in New York and North Carolina, I have seen some amazing things. I see so many simple mistakes that cause a lifetime of hurt, and I do not want you to fall into a similar situation.

Below, are some of the important things you need to know about a family law case. Do Not Talk About Your Case On Social Media

It is usually a good idea to refrain from posting on social media during your divorce. It may even be prudent to delete your account before your divorce starts. People you have known for decades may choose to support the other side in your divorce or custody battle. What you say to them in confidence online may end up being used against you in court.

This isn’t to say you should abandon your friends. You definitely need a support system while going through such a divorce or custody case. Spend time with them in real life. Get your mind off of the divorce or custody battle. You need friends but be careful what you say and who you say it to. Understand that your words may someday be used against you in court.

Do Not Post Photos Of Yourself Engaging In Questionable Behavior

I see this so often, and I can’t believe I have to say it, but I do. We live in the digital age. Everything you do, everything you post, it’s all out there for anyone to see. You do not want to post pictures of yourself doing illegal drugs or drinking excessively. You do not want the court to see you engaging in offensive or illegal behaviors. All of this can impact you negatively, especially in a custody case.

When the opposing party calls your fitness as a parent into question, it is your word against theirs. But, if you post photos that support their positions you have lost your ability to contest their allegations. If you must post, know that everyone will see it. Imagine every photo getting blown up into a life-sized portrait in court. Be cautious.

Do Not Harass Your Ex As Your Case Moves Forward

There can be a lot of anger in these cases. You may be upset that things have come to an end; you feel that your entire life is being turned upside down. You may want your spouse or significant other to experience the same unsettled feelings that you have been experiencing.

If you constantly harass or annoy the other side, know that you may be causing yourself serious harm. Your actions could result in court decisions going against you, or there could be potential charges should your behavior cross a line. Let your attorney do the heavy lifting. Do not get overwhelmed by the present, because it could cost you your future.

Do Not Make Any Decisions About Your Case Until You Know All Of Your Options

You want this over as soon as possible. You want a decision that provides you with the new normal. What you need to understand is that when you make a decision, you have to embrace the likelihood that it will be very difficult to change in the future. In other words, deciding to agree to all of your spouse’s demands to put the matter behind you may not be in your best interest.
